Terms of Use

These Terms of Use ("Terms") govern your access to and use of ThemeCloset — our website builder, hosting platform, theme marketplace, online-store tools, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

ThemeCloset (테마클로젯) is operated as a sole proprietorship registered in the Republic of Korea (Business Registration Number 211-17-08110). In these Terms, "ThemeCloset," "we," "our," and "us" refer to that business. You can reach us any time through your dashboard or at support@themecloset.com.

2. The Service

ThemeCloset lets you build, design, host, and publish websites without writing code. Depending on your plan, the Service may include:

  • Site builder & hosting — a block-based page editor, freeform canvases, custom pages, and managed hosting on a ThemeCloset subdomain or your own custom domain.
  • Themes & the theme marketplace — first-party and designer-published themes you can apply, customize, and switch between.
  • Online stores — product catalogs, carts, checkout, orders, shipping, and digital or physical goods, using payment providers you connect.
  • Memberships & paid content — paid memberships, subscriptions, and gated content you offer to your own audience.
  • Supporting tools — analytics, SEO controls, forms, media handling, comments, and internationalization (i18n).

The Service evolves continuously. We may add, change, or remove features, and we may set or adjust usage limits (for example on storage, bandwidth, pages, or products) to keep the platform reliable for everyone.

3. Accounts & Eligibility

  • Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service.
  • Accurate information. You agree to provide current, complete, and accurate registration details and to keep them up to date.
  • Account security. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use or security breach.
  • One person, one identity. You may not impersonate others, misrepresent your affiliation, or create accounts to evade a suspension or ban.

4. Your Content & License to Us

"User Content" means everything you upload, create, or publish through the Service — text, images, video, audio, files, product listings, code, and data.

  • You own your content. We claim no ownership of your User Content. As between you and us, it remains yours.
  • License to operate the Service. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, and display your User Content solely to operate, provide, secure, and improve the Service — for example to render your site, generate previews and thumbnails, serve it through our content-delivery and caching layers, and create backups.
  • Your responsibility. You represent that you have the rights to your User Content and that it does not violate these Terms or any law or third-party right.

5. Acceptable Use

You agree not to use the Service, and not to upload, publish, sell, or host any content or products that:

  • Are illegal or promote illegal activity, or that violate any applicable law or regulation.
  • Infringe anyone's intellectual property, privacy, or publicity rights.
  • Contain malware, viruses, or code intended to disrupt, damage, mine, or gain unauthorized access to any system or data.
  • Are defamatory, harassing, abusive, hateful, or that threaten or incite violence.
  • Contain child sexual abuse material, non-consensual intimate imagery, or other prohibited sexual content. We use automated moderation tools (including third-party services such as OpenAI) to detect and block such material.
  • Facilitate fraud, phishing, spam, deceptive commerce, or the sale of regulated goods you are not authorized to sell (for example weapons, controlled substances, or counterfeit items).

You also agree not to overload, probe, scrape, reverse engineer, or interfere with the Service or its infrastructure. We may review, monitor, and remove content, and we may limit or disable functionality, when we reasonably believe these Terms have been violated — but we are not obligated to monitor content.

6. Themes & the Marketplace

Themes made available through ThemeCloset — whether built by us or published by third-party designers — are licensed, not sold, to you. Applying a theme grants you a limited, non-exclusive, non-transferable right to use it on sites you operate through the Service. You may customize a theme's design within the tools we provide, but you may not redistribute, resell, or repackage a theme outside the Service.

If you publish themes as a designer, you represent that you own or have licensed all rights in what you submit, you grant us the right to list, display, and distribute it to users, and you agree to any separate designer or payout terms we provide. We may remove a theme from the marketplace at our discretion, including for quality, legal, or policy reasons.

7. Online Stores & Selling

ThemeCloset is a technology platform, not a store, payment provider, or party to your sales. We provide software and hosting that help you run your own online store; we do not buy or sell your products, do not process or hold funds, are not a bank, payment processor, or money transmitter, and do not act as agent, broker, or escrow for any transaction. If you use ThemeCloset to sell goods or services, you are the seller and merchant of record, and the contract of sale is solely between you and your customer.

Because we merely facilitate your use of the platform, ThemeCloset bears no legal responsibility or liability for your store's transactions — including the products or services sold, their quality, safety, legality, or delivery, pricing and taxes, refunds, or any dispute between you and your customers. To the maximum extent permitted by law, you assume full responsibility for your store and release us from any claim arising out of it.

  • Your obligations. You are solely responsible for your products, listings, pricing, descriptions, availability, fulfillment and shipping, customer service, returns, warranties, and for all taxes, duties, licenses, and legal disclosures your business requires.
  • Payments. Store payments are processed exclusively through the third-party payment providers you connect (such as Stripe, PayPal, or Paddle) under your own account with them. Your use of those providers is governed by their terms, and payouts, holds, fees, and chargebacks are handled by them, not by us. ThemeCloset never receives, holds, or disburses your customers' payments.
  • Disputes & chargebacks. Refunds, disputes, and chargebacks are between you, your customer, and the payment provider. You are responsible for resolving them and for any resulting fees or reversals.
  • Prohibited products. You may not sell anything prohibited under Section 5 or restricted by your payment provider.
  • Buyers. If you purchase from a store built on ThemeCloset, your contract is with that store's operator. Direct order, delivery, refund, and support questions to the store, not to ThemeCloset.

8. Memberships & Paid Content

You may offer paid memberships, subscriptions, or gated ("paid") content to your own audience. Those arrangements are between you and your members. You set the price, benefits, billing cadence, and cancellation and refund terms, and you are responsible for delivering what you promise and for honoring applicable consumer-protection laws. ThemeCloset provides the tools that enable memberships but is not a party to your relationship with your members.

9. Plans, Billing & Renewals

ThemeCloset offers free and paid plans for the platform itself.

  • Fees. If you choose a paid plan, you agree to pay its fees. We may change prices with reasonable advance notice; changes apply to your next billing cycle.
  • Processing. Platform subscription payments are handled by third-party processors (such as Stripe, PayPal, Paddle, or Polar). We do not store full card numbers on our servers.
  • Auto-renewal. Paid plans renew automatically (monthly or annually) until you cancel before the renewal date. You can manage or cancel your plan from the dashboard.
  • Refunds & taxes. Except where required by law, platform fees are non-refundable. You are responsible for any taxes associated with your plan.

10. Free Plan & Attribution

Sites on the free plan display a "Powered by ThemeCloset" mark in the footer. You agree not to remove, hide, obscure, or alter this mark on a free-plan site by any means, including CSS, scripting, or markup changes. Upgrading to an eligible paid plan removes the mark.

11. Custom Domains

You may connect a custom domain you own. You are responsible for registering and renewing the domain and for configuring DNS correctly. You represent that you have the right to use any domain you connect, and you remain responsible for your registrar's fees and terms.

12. Our Intellectual Property

All rights in the Service itself — including its software, algorithms, design, user interface, graphics, trademarks, and logos (excluding your User Content and third-party materials) — belong to ThemeCloset and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service under these Terms. You may not copy, modify, reverse engineer, decompile, or extract the source code of the Service except to the extent the law permits.

13. Feedback

If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without obligation to you.

14. Third-Party Services

The Service integrates with third-party providers — payment gateways, domain registrars, analytics, email delivery, and others. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms. Connecting a third-party account authorizes us to exchange the data needed to provide the integration.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any site built with it will achieve particular traffic, ranking, sales, or business results.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMECLOSET AND ITS AFFILIATES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR SALES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, THIRD-PARTY CONDUCT OR CONTENT, UNAUTHORIZED ACCESS, OR ANY BUGS, DOWNTIME, OR DATA LOSS. Our total liability for any claim will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100.

17. Indemnification

You agree to indemnify and hold ThemeCloset harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your User Content, your products or sales, your use of the Service, or your violation of these Terms or any law or third-party right.

18. Suspension & Termination

We may suspend or terminate your account or any site, with or without notice, if we reasonably believe you have violated these Terms or created risk or legal exposure for us or others. Where a site is suspended, we may provide an appeal path in your dashboard. On termination, your right to use the Service ends and your User Content may be deleted. You may stop using the Service and request account deletion from your dashboard at any time. Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, and indemnification) will survive.

We respect intellectual-property rights. If you believe content on a ThemeCloset site infringes your copyright, contact us at support@themecloset.com with enough detail to identify the work and its location. We may remove allegedly infringing content and may terminate repeat infringers.

20. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. Any dispute arising under them will be brought exclusively in the competent courts located in the Republic of Korea, unless mandatory local consumer law provides otherwise.

21. Changes to These Terms

We may modify these Terms from time to time. We will give reasonable notice of material changes (for example by email or a notice on your dashboard) and update the "Last updated" date above. Continuing to use the Service after changes take effect means you accept the revised Terms.
