Welcome to ThemeCloset ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the ThemeCloset website, platform, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service
ThemeCloset is a comprehensive website builder and hosting platform that allows users to create, design, manage, and publish their own websites. The Service includes but is not limited to drag-and-drop page building tools, templates, e-commerce integrations, analytics dashboards, and internationalization (i18n) features. We continuously update and improve the Service, which means features may be added, modified, or removed at any time without prior notice.

2. User Accounts and Eligibility
To access certain features of the Service, you must register for an account.
- Eligibility: You must be at least 18 years old to create an account and use the Service.
- Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials (username and password) and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
- Accurate Information: You agree to provide current, complete, and accurate information during the registration process and to update such information as necessary.

3. User Content and Acceptable Use
"User Content" refers to all text, images, videos, audio, data, links, code, and other materials that you upload, publish, or display on your ThemeCloset websites.

- Ownership: You retain all ownership rights to your User Content. We claim no intellectual property rights over the materials you provide to the Service.
- License to ThemeCloset: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content strictly for the purpose of operating, providing, maintaining, and improving the Service.
- Prohibited Content: You agree NOT to upload, post, or host any content that:
- Is illegal, unlawful, or promotes illegal activities.
- Infringes on any third party's intellectual property rights, privacy rights, or publicity rights.
- Contains malicious code, viruses, or any other software intended to disrupt or damage the Service or users' devices.
- Is defamatory, libelous, harassing, abusive, or threatening.
- Contains explicitly sexually explicit material, non-consensual pornography, or highly sensitive NSFW content. (Note: We employ automated moderation tools, including OpenAI technologies, to scan for and block prohibited content).
- Moderation and Removal: We reserve the right, but have no obligation, to review, monitor, and remove any User Content that violates these Terms or that we determine, in our sole discretion, is objectionable.

4. Subscriptions, Billing, and Payments
ThemeCloset offers both free and premium subscription plans.
- Fees: If you select a paid plan, you agree to pay all applicable fees associated with your chosen plan. Prices are subject to change, but we will notify you in advance of any price increases.
- Payment Processing: Payments are processed securely through third-party payment gateways (such as Stripe, PayPal, and Lemon Squeezy). By making a purchase, you agree to their respective terms of service. ThemeCloset does not directly store your full credit card information.
- Auto-Renewal: Subscription fees are billed on a recurring basis (e.g., monthly or annually) and will automatically renew unless you cancel your subscription prior to the renewal date.
- Refunds: All fees are non-refundable unless otherwise required by law or explicitly stated in our refund policy.
- Taxes: You are responsible for all applicable taxes associated with your use of the Service.

5. ThemeCloset Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content) - including but not limited to the underlying software, algorithms, code, design, UI/UX, graphics, trademarks, and logos - are and will remain the exclusive property of ThemeCloset and its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service strictly in accordance with these Terms. You may not reverse engineer, decompile, disassemble, or extract the source code of the Service.

6. Third-Party Services and Integrations
The Service may contain links to or integrations with third-party websites, applications, and APIs (e.g., analytics providers, payment gateways, custom domains). We do not endorse, control, or assume responsibility for any third-party services. Your interactions with these third parties are solely between you and the third party.

7. Disclaimers and Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THEMECLOSET DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND SYSTEM UPTIME.
We do not warrant that the Service will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components. We do not guarantee that any websites built using our Service will achieve any specific performance metrics, search engine rankings, or business results.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEMECLOSET, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) ANY BUGS, SERVER DOWNTIME, OR DATA LOSS.

9. Termination and Suspension
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease, and your User Content may be permanently deleted. If you wish to terminate your account, you may simply discontinue using the Service and request account deletion via the dashboard.

10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ThemeCloset is established, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the local courts of that jurisdiction.

11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes (e.g., via email or a prominent notification on the dashboard). By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
