Theme Closet ("Theme Closet", "we", "us", or "our") respects the intellectual property rights of others and expects users of our platform and services (the "Service") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to valid notices of claimed copyright infringement that are reported to our Designated Copyright Agent identified below.

Reporting Claims of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that material available through the Service infringes your copyright, you may submit a written notification (a "DMCA Notice") to our Designated Copyright Agent. Under 17 U.S.C. §512(c)(3), your DMCA Notice must include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material — for example, the URL of the page on which it appears.
  4. Your contact information, including your full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your DMCA Notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe that material you posted to the Service was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent. Under 17 U.S.C. §512(g)(3), your counter-notification must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Theme Closet may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.

Upon receipt of a valid counter-notification, we may restore the removed material in not less than ten (10) nor more than fourteen (14) business days following receipt of the counter-notice, unless our Designated Copyright Agent first receives notice from the party who filed the original DMCA Notice that they have filed an action seeking a court order to restrain the allegedly infringing activity.

Repeat Infringers

In accordance with the DMCA and other applicable law, Theme Closet has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentations

Please be aware that under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
